Maryland Legal News/Information

  • 4th Circuit Appeals Panel Invalidates Maryland Strip Club Law (News AVN). There is a good joke to be made here. I've spent 30 seconds trying to think of one. This would be low hanging fruit for even an average humorist.
  • New laws for those convicted of animal cruelty in Maryland ? (Baltimore City Paper). Exactly who would be against this?
  • Head Injury Verdicts (Maryland Accident Lawyer Blog)
  • Critics say law schools don't give students realistic career expectations (Washington Post)
  • Employer demands Facebook login credentials during interview (ZD Net). Did this really happen? Really?
  • Police beard bans persist despite court rulings (Hometown Annapolis). Interesting, I guess. But, ultimately, I have a hard time getting worked up about it one way or the other.
  • New medical malpractice opinion (sort of) from Maryland Court of Appeals

    Maryland Appellate Opinions

    The last five opinions from Maryland's appellate courts:

    • Wasserman v. Kay: commercial case involving Bernie Madoff victims
    • Matthews v. State: I love this line from this case: "What seems at first to be a legal problem frequently turns out to be a linguistic or a semantic problem. On this appeal, we come face to face with the enigma that an illegal sentence is not always an illegal sentence. We do not mean this as doubletalk. "
    • Kenan Cappel v. Riaso: confessed judgment case
    • Bonfiglio v. Fitzgerald: domestic case involving a QDRO. I knew what a QDRO was before the bar, I think. Now, I have no clue.
    • Muti v. University of Maryland Medical System: medical malpractice wrongful death case involving use plaintiffs.

    Maryland Legal News

    The purpose of this blog is largely to give me thoughts and opinions on issues that do not relate to personal injury. The problem is that all our law firm does is personal injury. Lately, I just have not had that many opinions on issues that don't relate to personal injury cases. But this ebbs and flows. To keep you coming back, I have to give you something. So here is the latest and greatest in Maryland legal news:

  • Woman guilty in fatal stabbing (The Capital)
  • Maryland Court of Appeals opinion on an administrative license suspension hearing. The court rejects some mumbo jumbo about a defendant's driver’s license that should not have been suspended because he was not given the opportunity to talk to a lawyer before refusing his BAC test.
  • Havre de Grace gets tough on carbon monoxide.

    Maryland Legal News Update

    • In Hill v. State, the court provides a transcript from the creepiest phone conversation ever while flipping the conviction of a sex offender. I don't have an opinion on the holding but this is reason #839 why I've never handled a criminal case. Depressing. The only good thing that came out of this case was an explanation of the correct pronunciation of Judge Battaglia's name (Ba-tal-ia).
    • Maryland Court of Appeals throws out murder conviction (Baltimore County FOP Lodge)
    • Mediation can bring justice with no need for a trial (The Washington Post). Might be an interesting article for parties in a case. I don't think lawyers will find much insight here.
    • Former state champ attempts to wrestle in Florida as trials on assault charges loom (Baltimore Sun)
    • Maryland wrongful death cases (overview of claims in Maryland).
    • Maryland Court of Special Appeals looks at enforcing arbitration agreements in Thompson v. Witherspoon
    • Baltimore man sentenced to death for 2008 York City murder (York Dispatch)
