Banishment of Sex Offenders?

The California 4th District Court ruled that Jessica's Law, a law that prohibits sex offenders from living within 2,000 feel of a school or park constitutes "banishment under another name."

I'm not sure I agree with the conclusion. If I did, I'm not sure I would find this to be a bad thing.
